# Still Terms of Service Effective and last updated: October 28, 2026 The license and terms for using Still. ## 1. Scope, acceptance, and eligibility “Still,” “we,” “us,” and “our” mean Aaron McGuire, the app’s developer and supplier. These Terms cover the Still website, direct-download Mac app, support, and related services. By purchasing, downloading, installing, or using the direct-download app, you agree to these Terms. Read the Privacy Policy (/privacy/) to understand data processing. If you do not agree to these Terms, do not proceed. Any consent required by applicable law will be requested separately. You must be at least 18 years old or the age of majority where you live and legally capable of entering a binding agreement. A parent or guardian must complete the purchase and accept these Terms for an eligible minor. If you use Still for an organization, you represent that you are authorized to bind that organization, and “you” includes it. If Still becomes available through the Mac App Store, the license supplied with that listing applies to that app purchase. Apple’s Standard EULA (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) applies unless the listing provides a custom EULA; Apple’s purchase and usage rules also apply. The direct-download license and direct-purchase refund policy below do not replace those App Store terms. Still is currently in development. A draft listing or demonstration is not a promise that the app is available for purchase. ## 2. limited license For the direct-download app, subject to any required payment, these Terms, and any purchase-specific terms, Still grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app on devices you own or control for your own lawful personal or internal business purposes. A license is for one natural person unless checkout expressly states otherwise. An organization must obtain a license for each user. You may not: - copy, resell, rent, sublicense, distribute, or commercially exploit the app except as expressly permitted; - reverse engineer, decompile, bypass technical controls, or derive source code except where applicable law expressly permits it; - use the services to violate law, privacy, publicity, intellectual-property, workplace, or recording-consent rights; - interfere with, overload, probe, scrape, or compromise the website, app, or related systems; or - misrepresent affiliation, impersonate another person, or use the product for surveillance, harassment, or deception. ## 3. walking, treadmill, and workspace safety Walking while working involves inherent risks, including distraction, falls, collision, repetitive strain, equipment movement, and injury. Still is camera software; it is not safety equipment and does not monitor your environment, gait, health, treadmill, standing desk, cables, pets, children, furniture, or other hazards. You are solely responsible for deciding whether walking while using a computer is safe for you; selecting, assembling, positioning, maintaining, and safely operating your treadmill, desk, camera, computer, cables, and other equipment; following all manufacturer, employer, and medical guidance; maintaining a clear workspace; using suitable speed and footwear; and stopping immediately if distracted, uncomfortable, unsteady, or unsafe. Still cannot make an unsafe setup, activity, or environment safe. Do not run, operate machinery, drive, or perform hazardous activity while using the app. To the extent permitted by law, you knowingly accept the ordinary risks inherent in the physical activity, equipment, workspace, and pace you choose, and you are responsible for injury, property damage, interruption, or other loss caused by those choices or by your failure to use reasonable care. This does not waive responsibility for conduct or rights that cannot lawfully be waived. Consult a qualified professional before changing physical activity if you have a medical condition, injury, balance concern, or other reason to seek advice. Estimated step counts and motion displays are informational only. They are not medical advice, fitness certification, or safety monitoring. ## 4. camera, calls, and third-party services You control when the camera and virtual camera are used and which applications receive output. You are solely responsible for selecting the correct camera and output; checking the feed before every call, recording, stream, or presentation; deciding whether the output is suitable; protecting confidential or sensitive information visible in frame; following employer and platform rules; and stopping camera use when appropriate. You are responsible for obtaining any legally required consent before recording, monitoring, processing, or transmitting another person’s image, voice, workplace, or communications. Do not rely on Still to provide recording notices, conceal sensitive material, prevent disclosure, preserve evidence, or guarantee that a call, recording, or stream is complete or acceptable. Still may interoperate with macOS, cameras, video-conferencing platforms, recording tools, website hosting providers, Apple, Lemon Squeezy, and other third-party services. We do not control those services and are not responsible for their availability, security, terms, policies, content, output, or changes. Third-party updates may affect compatibility. To the extent permitted by law, you assume the risks of your chosen hardware, network, software, accounts, and third-party services. ## 5. purchases, delivery, updates, and refunds Lemon Squeezy acts as merchant of record for direct purchases. Prices, taxes, currency, payment methods, receipts, delivery, and payment disputes may be governed by Lemon Squeezy’s checkout terms in addition to these Terms. You authorize the applicable charge and request immediate electronic delivery when you purchase. If these Terms conflict with checkout terms on a payment, tax, refund-processing, or merchant-of-record matter, the checkout terms control for that matter; these Terms otherwise govern the app and services. Product descriptions, availability, promotional copy, and prices may change before purchase. Updates, upgrades, compatibility, and continued availability are not guaranteed unless expressly promised at checkout. You may request a no-questions-asked refund within 30 calendar days after purchase through the seller contact in your Lemon Squeezy receipt or Lemon Squeezy My Orders. Eligible requests made within that period will be honored and returned to the original payment method; bank and card processing times may vary. This voluntary policy does not reduce any longer or additional mandatory consumer right. Direct-purchase refund requests do not require a photo, a reason, or a release. For App Store purchases when available, request refunds through Apple under its applicable policies. Mandatory consumer rights are not limited. ## 6. intellectual property and feedback The services, software, branding, designs, code, graphics, text, and other materials are owned by Still or its licensors and protected by intellectual-property laws. Except for the limited license above, no rights are granted by implication or otherwise. Third-party names, product names, and trademarks belong to their respective owners and are used only to identify compatibility or services. Their appearance does not imply sponsorship, affiliation, or endorsement. If you voluntarily provide ideas or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation, provided we do not publicly identify you as the source without permission. ## 7. no promise of perfect stabilization Results depend on hardware, lighting, framing, movement, backgrounds, other software, system resources, and third-party updates. Still may fail to detect or stabilize a person, may produce visual artifacts, and may be interrupted or unavailable. Marketing demonstrations are illustrative and do not guarantee your results. The website’s lifestyle video and its still image are AI-generated. The motion illustration is not a recorded benchmark. Neither is evidence of measured stabilization performance. ## 8. warranty disclaimer TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, COMPATIBILITY, OR UNINTERRUPTED OPERATION. We do not warrant that the services will prevent injury, satisfy employer requirements, work with every camera or conferencing platform, or be error-free. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you. ## 9. limitation of liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, STILL AND ITS OPERATORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS; SERVICE INTERRUPTION; MISSED OR FAILED CALLS, RECORDINGS, STREAMS, OR PRESENTATIONS; UNINTENDED DISCLOSURE; CAMERA OR OUTPUT ERRORS; EMPLOYMENT OR BUSINESS CONSEQUENCES; PRIVACY, RECORDING, OR CONSENT CLAIMS ARISING FROM YOUR CONDUCT; DEVICE OR THIRD-PARTY FAILURE; OR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM UNSAFE, DISTRACTED, OR IMPROPER USE. To the maximum extent permitted by law, total liability for all claims relating to the services will not exceed the greater of US $100 or the amount you paid for Still during the 12 months before the event giving rise to the claim. These limits apply regardless of legal theory and even if advised of possible damages. They do not exclude liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, gross negligence, or other non-waivable rights where applicable. ## 10. indemnity To the extent permitted by law, you agree to defend, indemnify, and hold harmless Still and its operators, affiliates, licensors, and service providers from claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use, violation of these Terms, infringement of another person’s rights, or unsafe or unauthorized recording, monitoring, or distribution. This obligation does not apply to the extent a claim results from our own unlawful conduct. ## 11. suspension, termination, and changes We may suspend or terminate access, support, or licenses for material breach, fraud, security risk, abuse, nonpayment, or legal necessity. You may stop using the services at any time. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnity, and dispute terms—will survive. We may update the services or these Terms. Material changes will be identified by a new “Last Updated” date and additional notice where required. Continued use after an effective change means acceptance, except where law requires another form of consent. ## 12. disputes and general terms Before filing a claim, please contact us and give us 30 days to attempt an informal resolution. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using an eligible small-claims process. Applicable law and forum depend on mandatory consumer law, the supplier identified at checkout, and the location of the parties. Nothing in these Terms waives rights or remedies that cannot legally be waived. These Terms do not require arbitration and do not waive an eligible small-claims process. These Terms and referenced policies are the entire agreement regarding the services. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of assets. We are not responsible for delay or failure caused by events reasonably outside our control, including internet or utility failures, third-party platform changes, labor disputes, natural disasters, governmental action, or widespread security incidents. Notices and transaction records may be provided electronically to the address or account associated with your purchase. ## 13. export, sanctions, and open-source software You may not export, re-export, or use the app in violation of applicable export-control, sanctions, or trade laws. You represent that you are not prohibited from receiving the app under those laws. The app may include open-source components governed by their own licenses. Those licenses control for the applicable components and are not restricted by these Terms. ## 14. Contact For purchase support or privacy requests, use the seller contact in your Lemon Squeezy order or receipt (https://app.lemonsqueezy.com/my-orders). Before purchasing, contact the developer through the existing Instagram contact account (https://www.instagram.com/getsmoothed.app/). Please identify your request as relating to Still. Do not send sensitive information through social messages; ask for a suitable support channel first.
